Yorktown Adopts Legislation Permitting Accessory Dwelling Units

May 29, 2025 – The Town Board has voted to permit accessory dwelling units (ADUs) in all single-family residential zones.

This significant legislative change aims to diversify housing options, ease financial burdens for homeowners, and enhance the welfare of the community. An ADU is a second, smaller dwelling unit located on the property of an existing home. These units can be attached within the primary building, added to the same building, or attached in a separate building.

"This is a thoughtful step forward for Yorktown," said Supervisor Ed Latcherman. "The ADU legislation aligns with our 2010 Comprehensive Plan and directly addresses housing needs within our community. It provides a flexible and impactful solution that benefits homeowners and those seeking more accessible housing options, all while maintaining the character of our single-family neighborhoods."

The creation of an ADU will require a special permit approved by the Zoning Board, followed by an administrative review and building permit from the building department.

The legislation, adopted by the Town Board on May 20, incorporates mitigation measures to address potential density impacts, limiting ADUs to a maximum of two bedrooms and 800 square feet. It also requires owner-occupancy of either the main dwelling or the ADU and robust environmental and design standards.

The legislation limits one ADU per lot and sets height restrictions for detached units to maintain neighborhood scale. For properties serviced by septic systems, owners must demonstrate the system's adequacy and obtain necessary County Health permits.

According to the Westchester County Housing Needs Assessment (November 2019), a significant number of Yorktown households face severe housing cost burdens. This legislation is anticipated to generate 30-40 housing units, contributing to the broader regional effort to address housing affordability. Neighboring Westchester County municipalities, such as Briarcliff Manor, Buchanan, Croton on Hudson, Hastings on Hudson, Irvington, and Pleasantville, have adopted ADU legislation.
